Terms and Conditions (T&Cs)
Introduction
These Terms and Conditions (hereinafter referred to as 'T&Cs') govern the business relationship between SoftMation e.U. (hereinafter referred to as 'Provider') and its customers. By using our services, you agree to these terms.
1. Scope
The following T&Cs apply to all contracts, services, and deliveries concluded between SoftMation e.U. and the customer unless explicitly agreed otherwise in writing.
2. Conclusion of Contract
A contract between SoftMation e.U. and the customer is only concluded through written confirmation of the order or through the provision of the agreed service.
3. Services
SoftMation e.U. provides services in the areas of test automation, web scraping, custom software development, and website development. The exact scope of services is specified in the respective order or offer.
4. Pricing and Payment Terms
All prices are in Euros and, unless otherwise stated, exclusive of statutory VAT. Invoices are payable without deductions within 14 days of the invoice date.
5. Third-Party Services
Our platform integrates third-party services like Google, GitHub, LinkedIn, and Facebook. These services may be used for login, API-based features, or social media automation. By connecting, you agree to their respective terms and privacy policies.
6. Data Access via Third Parties
We may access your name, email, or profile picture via connected services. These are used for personalization and functionality as described in our privacy policy.
7. User Responsibilities
You are responsible for your actions on the platform, including usage of connected services. You must comply with all applicable laws and third-party terms.
8. Termination
We may suspend or terminate access if these terms are violated, especially in the case of abuse of integrated services.
9. Changes to Services
We may update or remove third-party integrations at any time. Continued use implies agreement to such changes.
10. Liability
SoftMation e.U. is only liable for damages caused intentionally or through gross negligence. Liability for indirect damages, consequential damages, or lost profits is excluded unless mandatory statutory provisions provide otherwise.
11. Warranty
The customer must report defects immediately in writing. SoftMation e.U. is entitled to remedy the defect or provide a replacement at its discretion. Further warranty claims are excluded.
12. Final Provisions
If any provision of these T&Cs is invalid or becomes invalid, the validity of the remaining provisions remains unaffected. Austrian law applies. The place of jurisdiction is Linz, Austria.
